Terms and conditions of the Ceranika online store.

This is an English translation provided for convenience. In case of any discrepancies, the Polish version of this document shall prevail as the binding and authoritative text.

The Ceranika Online Store respects Consumer rights. A Consumer cannot waive rights granted to them under the Consumer Rights Act. Contract provisions less favorable to the Consumer than the provisions of the Consumer Rights Act are invalid, and the provisions of the Consumer Rights Act apply in their place. The provisions of these Terms and Conditions do not exclude or limit any rights of Consumers to which they are entitled under mandatory legal provisions, and any doubts shall be interpreted in favor of the Consumer. In the event of any unintentional inconsistency between the provisions of these Terms and Conditions and the aforementioned regulations, the latter shall prevail and the Seller shall apply them.

1. General provisions

  1. The Online Store available at https://ceranika.pl is operated by Nika Trojanowska, address: Ul. Gen. Władysława Andersa 27A/81, NIP: 9512506842, REGON: 386931357.
  2. Contact email: kontakt.ceranika@gmail.com, phone: +48 690 030 620 (standard call charges apply — according to the applicable operator's price list).
  3. Use of the Online Store requires the end device and IT system used by the Customer to meet the Technical Requirements.
  4. These Terms and Conditions are addressed to both Consumer and non-Consumer Customers using the Online Store, Electronic Services, or entering into Sales Agreements (with the exception of section XI of the Terms and Conditions, which is addressed exclusively to non-Consumer Customers).
  5. Acceptance of the Terms and Conditions is voluntary but required to create an Account and/or to place an Order by the Customer.
  6. Information presented in the Online Store constitutes an invitation to conclude a contract within the meaning of Art. 71 of the Civil Code, addressed by the Seller to Customers, and not an offer within the meaning of the Civil Code.
  7. Wherever the following capitalized terms are used in the remainder of these Terms and Conditions, they shall be understood as having the meaning given below, unless the context of their use clearly indicates otherwise:
    • PRICE — the gross remuneration amount (including tax) specified in Polish zlotys or another currency, due to the Seller for transferring ownership of the Product to the Customer in accordance with the Sales Agreement. The Price does not include delivery costs, unless the conditions of a Promotion applied by the Online Store provide otherwise.
    • BUSINESS DAY — one day from Monday to Friday, excluding public holidays.
    • CUSTOMER — (1) a natural person; or acting through an authorized person (2) a legal entity; or (3) an organizational unit without legal personality to which the law grants legal capacity; possessing full legal capacity.
    • CIVIL CODE — the Civil Code Act of April 23, 1964 (Journal of Laws 2014, item 121, as amended).
    • CONSUMER — a natural person performing a legal transaction with an entrepreneur that is not directly related to their business or professional activity.
    • CART — a service made available to every Customer using the Online Store, enabling them to place an Order for one or more Products.
    • PRODUCT — a movable item available in the Online Store that is the subject of a Sales Agreement between the Customer and the Seller, for payment of the Price. All Products presented in the Online Store are brand new.
    • TERMS AND CONDITIONS — this document specifying the rules for concluding Sales Agreements and the rules for providing and using services made available by the Seller through the Online Store.
    • ONLINE STORE — a platform enabling the Customer to place Orders and providing services made available by the Seller, available at: ceranika.pl.
    • SELLER — Nika Trojanowska, address: Ul. Gen. Władysława Andersa 27A/81, NIP: 9512506842, REGON: 386931357.
    • SALES AGREEMENT — a sales agreement within the meaning of the Civil Code, concerning the sale by the Seller to the Customer of a Product for payment of the Price plus any additional charges, including shipping costs.
    • ELECTRONIC SERVICE — the provision of electronic services within the meaning of the Act of July 18, 2002 on the Provision of Electronic Services.
    • ORDER — a declaration of will by the Customer expressing a direct intention to conclude a distance Sales Agreement, specifying the Product for which the Customer submits an offer to conclude a Sales Agreement and the Customer data necessary for the possible conclusion and performance of the Sales Agreement.

2. Electronic services in the Online Store

  1. The Seller provides the following free Electronic Services to Customers through the Online Store:
    • creation and management of an Account,
    • enabling Customers to place Orders and conclude Sales Agreements, on the terms set out in the Terms and Conditions;
    • presenting Customers with advertising content tailored to their interests;
    • enabling Customers to use Cart services;
    • enabling browsing of Content placed within the Online Store;
    • Newsletter.
  2. Additionally, for Customers who have created an Account, the Seller provides the following free services through the Online Store:
    • maintaining the Customer's session after logging into the Account,
    • storing and making available to the Customer, through the Account, the Order history.
  3. Use of the Account is possible after the Customer completes the following consecutive steps: filling in the registration form and accepting the Terms and Conditions, clicking the "Register" button.
  4. The Service Agreement is concluded when the Customer receives confirmation of the placed order sent by the Seller to the email address provided by the Customer during registration. The Account is provided free of charge for an indefinite period. The Customer may at any time and without giving a reason delete the Account by sending a request to the Seller, in particular via email to: kontakt.ceranika@gmail.com or in writing to: Ul.   5. Use of the Cart begins when the Customer adds the first Product to the Cart.
  6. The Cart is provided free of charge and is of a one-time nature, ending upon placing an Order through it or upon earlier cessation of placing an Order through it by the Customer.
  7. The Customer is obligated in particular to:
    • provide only true, current, and all necessary Customer data in forms made available within the Online Store;
    • immediately update data, including personal data, provided by the Customer to the Seller in connection with the conclusion of the Service Agreement or Sales Agreement;
    • use services and functionalities made available by the Seller in a manner that does not disrupt the functioning of the Seller and the Online Store;
    • use services and functionalities made available by the Seller in compliance with legal provisions, the Terms and Conditions, and accepted customs and principles of social coexistence;
    • use services and functionalities made available by the Seller in a manner that is not burdensome to other Customers and to the Seller;
    • make timely payment of the Price and other costs agreed by the Customer and the Seller in full;
    • timely collect Products ordered using the cash-on-delivery method, as well as Products that are the subject of a Reservation;
    • not provide or transmit Content prohibited by law within the Online Store, in particular Content infringing the property copyrights of third parties or their personal rights;
    • not take actions such as: sending or placing unsolicited commercial communications in the Online Store or placing any Content that violates legal provisions; undertaking IT activities or any other activities aimed at obtaining information not intended for the Customer; unauthorized modification of Content provided by the Seller, in particular Prices or Product descriptions presented within the Online Store.
  8. Complaints related to the provision of Electronic Services may be submitted, e.g.: in writing to: ul. Andersa 27a/81, Warsaw 00-159; electronically via email to: kontakt.ceranika@gmail.com.
  9. It is recommended that the Customer include in the complaint description: (1) information and circumstances concerning the subject of the complaint, in particular the type and date of occurrence of the irregularity; (2) the Customer's request; and (3) contact details of the complainant — this will facilitate and expedite the processing of the complaint by the Seller.
  10. The Seller will respond to the complaint promptly, no later than within 30 days from the date of its submission, in accordance with Art. 7a(1) of the Act, unless a different deadline results from legal provisions or separate regulations.

3. Sales Agreement conditions

  1. The main features of the service, taking into account the subject of the service and the manner of communication with the Customer, are described on the Product page or in another manner appropriate for the given Product, within the Online Store.
  2. The Seller enables placing Orders for Products in the Online Store.
  3. The Sales Agreement between the Customer and the Seller is concluded after the Customer places an Order.
  4. The Seller enables the Customer to place an Order through the Online Store in the following manner:
    • The Customer adds the selected Product(s) to the Cart and then proceeds to the order form.

4. Payment methods and deadlines

The Seller provides the Customer with the following payment methods under the Sales Agreement: electronic payments and card payments via the Tpay.com service. Electronic payment and card payment transactions are processed according to the Customer's choice through the Tpay.com service.

5. Delivery cost, methods, and timeframe

Product delivery to the Customer is paid unless the Sales Agreement provides otherwise. Delivery costs are indicated to the Customer on the Online Store pages and during the ordering process. Delivery of the Product is available within the territory of the Republic of Poland. The delivery time of the Product to the Customer is up to 7 Business Days, unless a shorter period is specified in the description of the given Product or during the ordering process.

6. Product complaints

The basis and scope of the Seller's liability towards the Customer if the sold Product has a physical or legal defect (warranty) are determined by generally applicable legal provisions, in particular the Civil Code.

The Seller will respond to the Customer's complaint promptly, no later than within 14 calendar days from the date of its submission.

7. Out-of-court complaint handling and claim pursuit methods

Detailed information regarding the possibility for Consumer Customers to use out-of-court complaint handling and claim pursuit methods, as well as the rules of access to these procedures, is available on the website of the Office of Competition and Consumer Protection at: https://uokik.gov.pl/pozasadowe_rozwiazywanie_sporow_konsumenckich.php

8. Right of withdrawal

A Consumer who has concluded a distance contract may withdraw from it within 14 calendar days without giving a reason and without incurring costs, except those specified by legal provisions. It is sufficient to send the withdrawal statement before the deadline expires.

9. Personal data protection

The controller of personal data processed in the Online Store in connection with the implementation of the provisions of these Terms and Conditions is the Seller. The rules for processing personal data are set out in the Privacy Policy of the Online Store.

10. Termination of the service agreement and changes to the Terms and Conditions

The Seller reserves the right to amend the Terms and Conditions for important reasons. The Seller will inform Customers of any changes to the Terms and Conditions at least 7 days in advance. Orders placed before the effective date of changes to the Terms and Conditions will be processed on the basis of the existing provisions.

11. Provisions concerning non-Consumer Customers

This section of the Terms and Conditions applies exclusively to non-Consumer Customers. In the event of a conflict between the provisions of this section and other provisions of the Terms and Conditions, the provisions of this section shall prevail.

The Seller has the right to withdraw from a Sales Agreement concluded with a non-Consumer Customer within 14 calendar days from the date of its conclusion. The Seller's liability under warranty for the Product towards a non-Consumer Customer is excluded.

12. License

Exclusive rights to Content made available within the Online Store by the Seller, in particular copyrights, the name of the Online Store, trademarks of the Seller, graphic elements forming part thereof, software, and database rights are subject to legal protection and belong to the Seller or entities with which the Seller has concluded appropriate agreements.

13. Final provisions

Agreements concluded through the Online Store are concluded in the Polish language. Matters not regulated in these Terms and Conditions shall be governed by the generally applicable provisions of Polish law, in particular: the Civil Code, the Act on Providing Electronic Services, the Consumer Rights Act, and the Personal Data Protection Act.
